BTC/ Sep Ebrahimzadeh/ Seneca LLC Settles Lawsuit
Over the past two years, multiple owners raised concerns about how the Association was being governed and filed lawsuits against the HOA and certain Board members. The claims focused on conflicts of interest, lack of transparency, misuse of Board authority, improper enforcement actions, failure to follow the Association’s governing documents, and violations of a prior 2011 settlement requiring rental-related fines and policy changes to be reviewed by an owner committee before enforcement. Owners also alleged that certain Board members, including Sepehr Ebrahimzadeh, Ali Sayyah, and Lori Midttun, used their positions to benefit their own real estate or property management businesses, consolidated voting power through proxy control, and limited owner access to information needed for meaningful oversight and accountability.
Instead of continuing toward trial, the parties resolved the case through a settlement. Under the settlement, the Association is required to hold an owner vote on specific bylaw amendments that directly address the problems raised in the litigation, including conflicts of interest, transparency, proxy concentration, access to records, and fair enforcement. Because courts cannot amend HOA bylaws, only the owners can adopt these changes. This upcoming vote is therefore the mechanism for owners to decide whether to implement long-term safeguards and prevent these issues from continuing and additional lawsuits from being filed.
This owner bought a unit in BTC, Sep the board president reached out him to make sure the bylaws and ccrs are followed, then solicited the owner for management using a competitors data. When the owner declined and told Sep he would self Sep scrutinized and immediately fined the owner. The owner hired an Attorney and the board backed off.
We believe there are hundreds of owners this is happening to, The board is keeping owners from communicating with each other by restricting contact information so to reduce backlash. That's why the board meetings are not recorded, all owners muted and the chat is disabled.

Lori Midttun 534 and Ali Sayyah 330 with Sep making 3 of the 4 residential board members working w Seps business. They don't see this as a conflict & refuse to disclose to the members.
